STUDENT USE OF SCHOOL-ISSUED COMPUTERS, DEVICES AND THE INTERNET

Portland Public Schools’ cofmputers/devices, network, and internet services (including Google for Education and/or other third-party services) are provided to support the educational mission of the schools. This policy and the accompanying rules also apply to other school devices issued directly to students (such as laptops and tablets), whether in use at school or off school premises. These devices and access to the internet are essential tools for teaching and learning for all students.

A. Use of Personal Electronic Devices
Any student use of personal electronic devices not issued by Portland Public Schools must be in accordance with Policy JFCK/JFCK-R.

B. Policy and Rules are Mandatory
Compliance with Portland Public School’s policies and rules concerning computer/device, network, and internet services use is mandatory. Students who violate these policies and rules may, after being given an opportunity to respond to an alleged violation, have their privileges limited, suspended or revoked. The building administrator shall have the final authority to decide whether a student’s privileges will be altered, based on the circumstances of the particular case and the need for access to the school’s instructional program. Such violations may also result in disciplinary action, referral to law enforcement and/or legal action.

C. No Right to Privacy
Portland Public Schools’ computers/devices, network, and internet services remain under the control, custody and supervision of the district at all times. The district monitors all computer/device and internet activity by students. Students have no expectation of privacy in their use of school computers/devices, networks, and internet services, whether they are used on or off school property.

D. Filtering Technology
Portland Public Schools utilizes filtering technology designed to block materials that are obscene or harmful to minors. Portland Public Schools takes precautions to supervise student use of the internet and electronic communications, and to prevent the unlawful disclosure, use or dissemination of personally identifiable information about students. Portland Public Schools educates students about safety on the internet, appropriate online behavior and cyberbullying awareness and response, but parents should be aware that Portland Public Schools cannot reasonably prevent all instances of inappropriate computer/device use by students that may violate Board policies and rules, including access to objectionable materials and communications.

E. Notification of Policy and Rules
Students and parents shall be informed of this policy and the accompanying rules through handbooks and/or other means selected by the Superintendent.

F. Implementation and Rules
The Superintendent or designee is responsible for implementing this policy and the accompanying rules. Additional administrative procedures or school rules governing the day-to-day management and operations of the district’s computers/devices and network may be implemented by the Superintendent, consistent with Board policies and rules.

Portland Public Schools (PPS) provides elementary students device access consisting of a bank of iPads in grades PK-2 and one-to-one computing with a Chromebook in grades 3-5 for their use at school. Devices are used to access assignments and to learn skills to become digitally literate. A digitally literate student is a safe, responsible, and critical user of technology.

Use of this device is a privilege. Please discuss with your child the points below related to the responsibility of taking care of the device and the use of the internet. To ensure a positive learning environment for individuals and the learning community, compliance with the PPS Student Computer and Internet Use Policy and the PPS Student Computer and Internet Use Rules, and this Agreement while using the PPS network and device is essential. Consequences for lack of compliance may result in disciplinary action or denial of access to the device, our network, or certain services. By signing, you agree to the following conditions in exchange for access to a PPS-issued device:

• The student will only use their own Clever badge or username and password to access the network and other school systems.
• All files stored on the student PPS-issued device will not be private, and there is no expectation of privacy related to use of the device. PPS personnel can review devices, device use, and/or files at any time.
• The student will report any problems with the PPS-issued device to the teacher as soon as they become aware of the problem.
• The student, with the support of their teacher, will agree to abide by all applicable local, state, and federal laws related to use of the PPS network and PPS computers/devices.
• The student will have access to and use of Google Workspace for Education Plus managed by the Portland Public Schools and to the terms of Google’s privacy policy related to the collection of use of student data. This agreement serves as the legally-compliant notice for consent regarding student access or use of Google’s service.
• PPS will seek to filter inappropriate content on the Internet, but PPS cannot reasonably prevent access to all inappropriate content.

A digitally literate student is an informed, responsible, and critical user of technology as they explore, create, learn, and make positive and healthy connections. Use of this device is a privilege. Please discuss with your child the points below related to the responsibility of taking care of the device and the use of the internet. To ensure a positive learning environment for individuals and the learning community, compliance with the PPS Student Computer and Internet Use Policy and the PPS Student Computer and Internet Use Rules, and this Agreement while using the PPS network and device is essential.

Consequences for lack of compliance may result in disciplinary action or denial of access to the device, our network, or certain services. By signing, you agree to the following conditions in exchange for access to a PPS-issued device:

• The student will only use their own username and password to access the network and other school systems.
• All files stored on the student PPS-issued device will not be private, and there is no expectation of privacy related to use of the device. PPS personnel can review devices, device use, and/or files at any time.
• Either student or parent/guardian will report any problems with the PPS-issued device to the teacher as soon as they become aware of the problem.
• Personalizing the device by putting on stickers, for example, is not allowed. Misusing the device in a way that damages it or renders it unusable will result in a replacement device or repairs being paid for by the parent/guardian and/or the student.
• The PPS-issued device will be returned along with all of its accessories, including charging cord, by the last day of school each year, promptly upon withdrawal from PPS, or immediately whenever requested by the PPS administration. Charges for the replacement amount for the device and cord will be the responsibility of the parent/guardian and/or student if these are not returned as required by this Agreement.
• The student will have access to and use of Google Workspace for Education Plus managed by the Portland Public Schools and to the terms of Google’s privacy policy related to the collection of use of student data. This agreement serves as the legally-compliant notice for consent regarding student access or use of Google’s service.
• Parent/guardian agrees to supervise their child’s use of the internet on their PPS-issued device. PPS will seek to filter inappropriate content on the Internet, but PPS cannot reasonably prevent access to all inappropriate content.
• I have read, and agree to abide by, the PPS Student Computer and Internet Use Policy and the PPS Student Computer and Internet Use Rules.
• I agree to abide by all applicable local, state, and federal laws related to use of the PPS network and PPS computers/devices.

PPS will be providing insurance, at no cost to our students and families. However, in order to offset the cost of device insurance, we are asking families who are able to do so to contribute $40 toward the self-insurance pool. A student is eligible for only one replacement device or replacement charging cord if a device breaks or malfunctions due to an accident or a cause outside the student’s control including: there is theft, fire, power surge, natural disasters, and accidental (non-negligent) damage both at home and in school. In case of theft, a police report must be filed and furnished to the school administration as soon as the theft is discovered. The coverage extends from the time we receive this signed form until the end of the school year.

A student is not eligible for a free replacement device if there is: damage due to negligence, abusive treatment or intentional destruction. In the case of a theft, if a police report is not filed within one week of the loss it will not be covered. This insurance does not cover lost chargers for the Chromebooks or iPads. In such cases, repairs or replacement will be the sole responsibility of the student’s parents/guardians.

The cost for replacing technology are as follows:

Chromebook - $225, Chromebook charger - $40, Laptop Bag - $20.

Student, parent/guardian will be notified if there is a fee via the IC portal which can be paid in the IC Campus Payment portal. Alternatively, cash is accepted and checks can be made out to Portland Public Schools with the memo IT and student ID number. These should be submitted to the school’s secretary in an envelope marked with: student name, student ID number and what the payment is for.

COMPULSORY SCHOOL ATTENDANCE

Compulsory education is essential to the preservation of the rights and liberties of the people and the continued prosperity of our nation. Maintaining regular student attendance is necessary to achieve the goal of an educated citizenry.

Compulsory Attendance Ages

Under state law, full-time attendance at school is required of every child between 6 years of age and under age 17, unless they have received a high school diploma or its equivalent.

Although not required to enroll in school, if a child who is 5 years of age and under age 6 is voluntarily enrolled in a public school and has not formally withdrawn, that child is required to attend school when it is in session.

Excusable Absences from School

A person’s absence from school is excused when the absence is for one of the following reasons:

1. Personal illness;
2. An appointment with a health professional that must be made during the regular school day;
3. Observance of a recognized religious holiday when the observance is required during the regular school day;
4. A family emergency;
5. A planned absence for a personal or educational purpose which has been approved; or
6. Education disruption resulting from homelessness, unplanned psychiatric hospitalization, unplanned hospitalization for a medical emergency, foster care placement, youth development center placement or some other out-of-district placement that is not otherwise authorized by an IEP or other education plan or Superintendents’ agreement.

Adult Responsibility for School Attendance
Parents or other adults having control of a person of compulsory attendance age are responsible for

ensuring that a student attends school as required by law. The Portland Board of Public Education (“Board”) expects school administrators and staff to work with families in an effort to ensure compliance.

Exceptions to the Compulsory Attendance Requirement
A child may be excused from compulsory attendance at school if they meet the requirements in one of the following sections:

A. They have graduated from high school before that person’s 17th birthday;
B. They have:

1. Reached the age of 15 years of age or completed the 9th grade;

2. Obtained permission to leave school from their parent;

3. Been approved by the principal for a suitable program of work and study or training;

4. Obtained permission to leave school from the Board or its designee; and

5. Agreed in writing with that person’s parent and the Board or its designee to meet annually until that person’s 17th birthday to review that person’s educational needs.

If a request to be excused from school is denied pursuant to this section, the student’s parent may appeal to the Commissioner of Education.

3. They have matriculated and are attending an accredited, post-secondary, degree-granting institution as a full-time student. An exception to the compulsory attendance law under this paragraph must be approved by the Commissioner of Education.
4. They are enrolled in an online learning program or course.

Alternatives to Attendance in Public School
A person who is age 6 or older and under age 17 shall be excused from attending a public day school if they obtain equivalent instruction as allowed by law. A person under age 6 is not required to comply with this section.

Equivalent instruction alternatives are as follows:

1. A private school approved for attendance purposes pursuant to state law and regulations;
2. A private school recognized by the Department of Education as providing equivalent instruction;
3. A home instruction program that complies with state law and regulations;
4. Any other manner arranged by the Board and approved by the Commissioner of Education; or
5. Pursuant to 20-A MRS Sections 5104-A or 8605 (approved alternative education program or adult education program).

A student shall be credited with attendance at a private school under Paragraphs A or B only if the legally required certificate from the private school is filed with the student’s school unit.

STUDENT CONDUCT EXPECTATIONS AND RULES ON SCHOOL BUSES

 

The safety and welfare of students who ride school buses; drivers and assistants who staff school buses; and motorists and pedestrians depend on proper behavior and observance of the following rules. These rules apply to all students at all times while being transported in a school bus, including but not limited to regular bus runs; after school “late runs” or “activity trips”; academic and extracurricular field trips; and athletic trips.   By law, the school bus driver is responsible for the bus and its passengers, and has authority to enforce rules necessary for the safe operation of the bus. Coaches, teachers, other school staff and volunteers who are on the bus are expected to support the driver in enforcing conduct and safety expectations.

 

In cases when a student does not conduct themselves properly on a school bus, the infraction shall be brought to the attention of the building Principal by the bus driver.  Drivers are expected to bring all conduct issues to the Principal’s attention and not wait until a serious incident occurs.  The building Principal, in consultation with the Director of Transportation, will determine the appropriate consequences based on the nature of the incident; the student’s disciplinary history; and other relevant factors.

 

Serious and/or repeated disciplinary problems on the bus may result in a student having their riding privileges suspended by the Principal in consultation with the Director of Transportation.  In such cases, the parent/guardian is responsible for transporting the student to and from school or other activities.

 

1. In addition to Board policies and school rules which remain in force on school buses, the following specific rules apply to students using school bus transportation. Students are expected to be on time at the bus stop, recognizing that scheduled pick up and drop off times are approximate.  The bus will not wait for students who are tardy.  Students are not to run after the school bus.  Bus drivers have been instructed not to stop for any student who runs after the school bus.   School buses will not return to bus stops to pick up students who are tardy.
2. Students are expected to wait for the bus to come to a complete stop before trying to board or depart.  If a student must cross a roadway, the student must wait for the driver to signal to the student when the driver has determined that all traffic has stopped.  Students must cross roadways at least ten (10) feet in front of the bus, so that they are in full view of the driver.   This crossing procedure applies to students who are boarding and who are being discharged from a school bus. 
3. Students must use the stair handrails when boarding and being discharged from a school bus.

4.   Students must obey all directions from the bus driver.

5.   Students must sit properly in their seats at all times when inside the school bus. If a driver

      or bus assistant assigns seats, students must sit in the assigned seat. Students are expected

      to utilize the authorized number of seats in each row (e.g., three (3) students per seat in

      most school buses), no more than one student may occupy a single seat.

6.   Students must use inside voices, also referred to as Level One voices, at all

      times in a school bus.  Students must refrain from any activity that is distracting

      to the driver.

7.   Students may not extend any object or body part out of an open bus window, or

      throw any object out of an open bus window or door.

8.   Students may not eat or drink while in a school bus, except with permission of

      the driver.

9.   Students may not transport any live animals, reptiles, insects, etc., in a school

      bus.

10. Students are expected to keep aisles clear and to store personal items,

      including backpacks, on their laps or under their seats.

11. Students are expected to keep the school bus clean and sanitary.  A waste

      container is provided at the front of every school bus. students must use this

      waste container only when boarding or being discharged from the school bus.

12. One bus stop location for morning transportation, and one bus stop location for

      afternoon transportation, is assigned to each student.  In the morning, students

will be allowed to board, and in the afternoon students will be discharged only at

their assigned school bus stops.

Athletic and Co-Curricular Activities

Code of Conduct for Middle and High School Students

 

Since participation in athletic and co-curricular activities is a privilege, it is important that students, parents/guardians and other interested persons are aware of the following rules and regulations. As representatives of the schools, students are expected to exhibit appropriate behavior at all times.  These rules are adopted by the Portland Board of Public Education (The Board) in order to support the social, emotional and physical well-being of students and promote healthy, enriching and safe athletic and co-curricular opportunities for all students. 

 

1. Students in good standing may participate in the athletic and co-curricular activities of their school. A student is considered in good standing if they are not the subject of any disciplinary action for violation of any policy or school rule and is currently academically eligible based on MPA guidelines and this policy.

 

2. For the purpose of this policy, any student who misses any portion of the school day with an unexcused absence may NOT participate in athletic and co-curricular activities. All exceptions to this requirement must be approved by a building administrator/Co-Curricular Administrator. 

 

3. Students suspended from school (including in-school and out-of-school suspension) will not practice, participate, attend or compete in athletic and co-curricular activities during the days of suspension.

 

4. Students are required to abide by all Board policies, school rules and any additional rules, and/or training guidelines imposed by coaches or advisors.   Any additional rules and/or training guidelines must be consistent with Board policies and be approved by the Co-Curricular Administrator in advance of the season/activity.
    
5. Student use of tobacco, alcohol and drugs is illegal and negatively affects student health, safety and performance.  Students participating in athletic and co-curricular activities carry a responsibility to themselves, their fellow students, coaches/advisors, parents and school to set the highest possible example of conduct, sportsmanship and training, which includes avoiding any involvement with tobacco, alcohol and drugs.  Therefore, students participating in athletic and co-curricular activities will not engage in the prohibited behaviors and activities described in Policy JICH/R (Drug and Alcohol Use by Students) and Policy ADC/R (Tobacco Use and Possession) at any time or place from the beginning of the student’s first athletic or co-curricular activity of the school year through the end of the school year. Students found in violation of these infractions will report to their Co-Curricular Administrator who will proceed with disciplinary procedures as outlined in Policy JICI-E Co-Curricular Code of Conduct Administrative Procedures – Disciplinary/Contractual Matrix.
    
6. Students are expected to conduct themselves so as not to discredit themselves, their team or organization, their coach or advisor, or their school.  If a student is charged with a crime, they may be suspended from participation in athletic and co-curricular activities until the case is adjudicated.  A student who is convicted of a crime may be suspended from participation in activities for a period of time to be determined based upon the facts of the particular case.

 

7. Students will be responsible for all uniforms and equipment issued to them by the school.  The cost of replacing damaged or lost uniforms/equipment will be the responsibility of the student and parent/guardian.  A student may not be issued uniforms/equipment for a new activity until all uniforms/equipment from a previous activity have been returned or paid for.  All exceptions to this requirement must be approved by the building administrator/co-curricular administrator.

 

8. Students and their parents/guardians are required to sign the Athletic/Co-Curricular Contract as a condition of participating in athletic and co-curricular activities.  Students participating in fall sports and their parents/guardians must sign the contract at the beginning of pre-season.  All other students who plan to participate in athletics and co-curricular activities at any time during the school year and their parents/guardians must sign the contract prior to beginning their first activity.

 

A.        Academic Eligibility
 

High School

Students who participate in athletics and co-curricular activities must meet the following academic eligibility requirements.
 

1. Eligibility is determined by academic standing and progress, where “academic” is defined as “credit-bearing.” Eligibility and progress will be checked approximately once a month.  A schedule of check-in dates will be determined annually.  A student must be academically eligible on the first day of the activity in order to begin participating. For 10^th through 12^th graders, eligibility for activities which begin in the fall will be determined by grades checked the previous June.

 

2. Eligibility is based on the course load scheduling of each school.  Students must be making adequate progress to learning standards, with adequate progress defined by the district and school, for the minimum load of classes in order to be academically eligible to participate in athletic or co-curricular activities.
    
   1. Portland High School and Casco Bay High School students must take and be making adequate progress to learning standards for five academic classes per semester, or the equivalent as determined by the Principal.
   2. Deering High School students must take and be making adequate progress to learning standards for three academic classes per semester, or the equivalent as determined by the Principal.
   3. A course at Portland Arts & Technology High School will be counted as two courses in determining minimum course load.
   4. Requirements for home school students are addressed in Policy IHBGA (Home Schooling-Participation in School Programs).
   5. For students attending other educational alternative programming, the student meets equivalent academic standards as those established for regularly enrolled students participating in the activity and provides evidence that the academic standards are being met.
3. The Principal or his/her designee is responsible for certifying the eligibility of all students participating in athletic and co-curricular activities.
    
4. Students with identified disabilities must meet the same eligibility requirements as other students. Adjustments may be made by the IEP Team or 504 Team as written in that student’s plan.
    
5. Any student promoted from 8^th grade to 9^th grade will be considered academically eligible for fall activities in the 9^th grade.

 

Middle School

 

1. To be eligible to participate in co-curricular activities, all students:
    
   1. Must take and pass a full middle school schedule of classes each marking period.  Habits of Work and Learning (HOWL) provide a strong foundation for lifelong learning and success. Therefore, middle school co-curricular eligibility is clearly aligned with those habits of respect, responsibility, and perseverance. To be eligible to participate in co-curricular activities at the Portland Middle Schools, students must earn HOWL scores of 2 or higher for Respect, Responsibility, and Perseverance in all classes.
   2. Requirements for home school students are addressed in Policy IHBGA (Home Schooling-Participation in School Programs).
   3. For students attending other educational alternative programming, the student meets equivalent academic standards as those established for regularly enrolled students participating in the activity and provides evidence that the academic standards are being met.

 

2. The Principal or his/her designee is responsible for certifying the eligibility of all students participating in athletic and co-curricular activities.
     

B.  Academic Ineligibility

 

High School

 

1. 1. Level 1: If a student is ineligible, they will be removed/suspended from active play/participation for 7 calendar days. The student can participate in practices but cannot actively take part in games, scrimmages against other schools, competitions, tournaments, or exhibition games. The student will work with building administration to create/modify a contract detailing their plan to make acceptable progress toward proficiency.

 

1. 2. Level 2. If a student continues to be academically ineligible at the end of the Level 1 Period, they will be removed from all official participation/contact with the team/activity for 7 additional calendar days. During this period of time, a school staffing meeting will be held to examine the student’s contract, make any necessary modifications, and review relevant policy.   
       
   3. Level 3:  If a student continues to be academically ineligible at the end of the Level 2 Period, they will be deemed ineligible for the rest of the season or the duration of the activity. Building administration will continue to work with the student to help regain status for the future.
       

A written appeal may be made to the Principal if a student and their parent/guardian believes extenuating circumstances have impacted their ability to pass a course.  The Principal will review the matter and inform the student and their parents/guardian of the decision within a reasonable time. The student remains ineligible during this review.  The decision of the Principal is final.

 

Middle School

 

1. Level 1:  If a student is found to be ineligible, they will be placed on Academic Warning. The Academic Warning period for the middle schools is 5 school days. During this time the student is able to participate and be part of the team or activity. They can participate in games, scrimmages, competitions, tournaments, exhibition games, and/or other official team/club activities IF they attend and engage in all recommended support structures to bring all grades to expected levels, either at or making acceptable progress toward proficiency. The student will work with building administration to create a contract detailing their plan.
2. Level 2:  If a student continues to be ineligible at the end of the Level 1 Warning Period, they will be removed/suspended from active play/participation for 5 school days. The student can participate in practices but cannot actively take part in games, scrimmages against other schools, competitions, tournaments, or exhibition games. The student will continue to work with building administration to create/modify a contract detailing their plan to make acceptable progress toward proficiency.
3. Level 3:  If a student continues to be ineligible at the end of the Level 2 Suspension Period, they will be removed from all official participation/contact with the team/activity for 5 school days. During this period of time, a school staffing meeting will be held to examine the student’s contract, make any modifications to which the team agrees, and to review relevant policy.
4. Level 4:  If a student continues to be ineligible at the end of the Level 3 Removal Period, they will be deemed ineligible for the rest of the season or the duration of the activity. Building administration will continue to work with the student to help regain eligibility status for future activities/seasons.
    

A written appeal may be made to the Principal if a student and their parent/guardian believes extenuating circumstances have impacted their ability to make progress with Habits of Work and Learning scores.  The Principal will review the matter and inform the student and their parents/guardian of the decision within a reasonable time. The student remains ineligible during this review.  The decision of the Principal is final.

 

C.  Disciplinary Action

 

Improper conduct, as determined by school personnel, will result in disciplinary action up to and including removal/suspension from the team or activity in addition to any discipline imposed under applicable Board policies or school rules.   The Co-Curricular Administrator, administration and coaches/advisors are expected to enforce all policies and school rules at all times and to use their best judgment in applying penalties for violations.  The advisor or coach will consult with the Co-Curricular Administrator prior to suspending a student from an activity or team. 

 

Repeat or extreme violations of any team/activity rules, school rules and/or Board policies may warrant administrative review and additional sanctions.  Violations are cumulative during a student’s middle school career, but do not carry over to the high school.  Violations during a student’s high school career are cumulative.

 

For infractions involving drugs, alcohol and/or tobacco, disciplinary action will be taken as specified below in addition to any discipline imposed under policies JICH/R (Drug and Alcohol Use by Students) and ADC/R (Tobacco Use and Possession).

 

Activity/Team Leadership Positions

A student elected to a leadership position for a team/activity forfeits that position for the duration of the season/activity if they are suspended from the team or activity for any reason.   A second suspension from a team or activity any time during the student’s high school career will result in the loss of any leadership designation held for twelve calendar months.  A third suspension during a student’s high school career will result in the loss of any leadership position for the remainder of the student’s career.    

 

Appeal of Disciplinary Suspension from Team/Activity
 

• If a student and their parent/guardian wish to appeal the suspension, they must do so in writing to the Co-Curricular Administrator within two school days of notice of the suspension decision. The Co-Curricular Administrator will conduct an investigation as they deem advisable and render a decision, in writing, to the student and their parent/guardian within three school days, when possible.

 

• If the student and their parent/guardian are dissatisfied with this decision, the decision may be appealed in writing to the Principal within two school days. The Principal will conduct whatever investigation they deem advisable and render a decision, in writing, to student and their parents/guardian within a reasonable time. The Principal’s decision is final.

 

• The student will remain under suspension during the appeal process.
